Client Services Agreement
This Client Services Agreement (“Agreement”) governs the purchase and use of services and products provided by Foundation Scholarship Services LLC (“Company”). By booking or purchasing and submitting payment, the client (“Client”) agrees to the terms below. The version of this Agreement in effect on the date of booking or purchase governs that transaction. This version supersedes all prior versions going forward.
1. Scope of Services
Client is purchasing educational consulting services or related products, which may include:
- Scholarship guidance
- College application advising
- Strategy and planning consultations
- Written essay review and feedback
- Foundation Family membership
- CaT for Girls computing courses
- Digital products (downloadable files)
- General academic advisory support
These are referred to collectively as the “Services.”
Where the Client is an adult purchasing Services for their own education, including graduate or professional programs, references in this Agreement to the “student” and to the parent or family refer to the Client.
2. Session Structure
Consultation services are delivered through scheduled sessions.
- Each session is a minimum of 60 minutes.
- Extended sessions must be scheduled in advance and may be conducted as a 90-minute session or as an additional session, as agreed before the appointment.
- Sessions are conducted by video conference or telephone.
3. Essay Review
- Essay reviews are delivered as written feedback. They do not include a session unless a session is purchased separately.
- Each essay submitted for review may be no longer than 1,000 words. If an essay exceeds that length, the Company will notify Client before beginning the review.
- Written reviews are returned within five business days of the Company’s receipt of the essay. Business days exclude weekends and federal holidays.
4. Student Work
The student is the sole author of all essays and application materials.
- The Company provides feedback, coaching, and proofreading only.
- The Company does not write, rewrite, ghostwrite, or draft any portion of a student’s essay, application, or other submitted work, and will not do so on request.
- Client is responsible for ensuring that everything submitted to any college, scholarship sponsor, or program is the student’s own work.
5. Fees and Payment
- Client agrees to pay the fees for the selected service or product as published at foundationscholarship.com at the time of booking or purchase.
- Extended sessions may be billed at a prorated rate or as a separately agreed session.
- Payment is required in advance of each session or deliverable unless otherwise agreed in writing.
- No services will be provided without confirmed payment.
Payments are processed through third-party scheduling and payment platforms. By completing a booking or purchase and submitting payment, Client authorizes the charge and agrees to all terms of this Agreement.
6. Strategy Review Credit
The fee paid for the Scholarship Readiness & Strategy Review is credited in full toward the price of a Senior Sprint, a Senior Capstone, or a Foundation Family membership booked within three months of the date of the Review session.
- The credit applies one time, to one package.
- The credit does not apply to standalone essay reviews, individual sessions, digital products, or CaT for Girls courses.
- The credit has no cash value and is not refundable or transferable.
- If Client receives a refund of the Review fee under Section 8, no credit remains available.
7. Rescheduling and Cancellation
- Sessions may be rescheduled with at least 24 hours’ notice.
- Cancellations made with less than 24 hours’ notice may be forfeited and non-refundable.
- Failure to attend a scheduled session, referred to as a no-show, results in the session being charged in full and non-refundable.
- A no-show for a Scholarship Readiness & Strategy Review forfeits the session fee. The satisfaction guarantee in Section 8 applies only to a session the Client actually attended.
8. Refund Policy
- Scholarship Readiness & Strategy Review: if Client is not satisfied, Client may request a full refund within 7 days of the session.
- All other completed sessions are non-refundable.
- Unused prepaid sessions may be refunded at the Company’s sole discretion.
- Essay reviews are non-refundable once the written review has been delivered.
- Digital products are delivered immediately upon purchase, and all sales of digital products are final.
- Refunds relating to CaT for Girls courses are governed by Section 11.
9. Nature of Services (No Guarantees)
Services are advisory in nature and are based on professional experience and judgment.
The Company makes no guarantees regarding:
- Scholarship awards
- College admissions outcomes
- Financial aid results
10. Client Responsibility
Client acknowledges that:
- All decisions and actions remain their sole responsibility.
- Outcomes depend on factors beyond the Company’s control, including individual effort, qualifications, and third-party decisions.
- Application deadlines and submissions remain Client’s responsibility. The Company provides a written application calendar and deadline guidance for the services that include them, and submitting on time is the family’s responsibility.
11. Youth Programs
This Section applies only to participants under 18 years of age. CaT for Girls courses enroll students who are minors, and Foundation Family includes sessions attended by students.
- A parent or legal guardian must complete enrollment and accept this Agreement on the student’s behalf.
- Classes and student sessions are held live by video conference.
- Students and families may not record, photograph, or redistribute any class or session.
- Students are expected to conduct themselves respectfully. The Company may remove a student from a course for conduct that disrupts the class, and will refund the fee for sessions not yet held.
- If the Company cancels a scheduled class, it will either reschedule that class or refund the fee for it.
- The Company may cancel a course before it begins if minimum enrollment is not met. In that case Client receives a full refund.
12. Use of Digital Products
Digital products are licensed for the personal, non-commercial use of the purchasing family. They may not be resold, redistributed, or shared publicly.
13. Confidentiality
The Company will maintain the confidentiality of client information and will not disclose personal information except as required by law.
14. Limitation of Liability
To the fullest extent permitted by law:
- The Company shall not be liable for any indirect, incidental, or consequential damages.
- Total liability shall not exceed the total amount paid by Client for the Services.
15. Governing Law
This Agreement is governed by the laws of the State of California.
16. Entire Agreement
This Agreement constitutes the entire agreement between the parties and supersedes all prior discussions or agreements.
17. Acknowledgment
By booking or purchasing and submitting payment, Client acknowledges that they have read, understood, and agree to this Agreement.
